1. Acceptance of these terms

By accessing our website, submitting a request, or engaging our services, you confirm that you are at least 18 years old and agree to be bound by these Terms. If you do not agree, please do not use our website or services.

2. Our services

Colorado Eco Garden provides lawn-conversion, native and low-water eco-garden design, and installation services in the Denver metro area and surrounding Colorado communities. The specific services for any project are defined in a separate written service agreement between you and us.

3. Consultations, assessments & the consultation fee

We offer yard consultations and assessments to evaluate your property and discuss what is possible. A consultation fee may apply.

If you proceed with a project and sign a service agreement, the consultation fee is credited toward the cost of your project. If you choose not to proceed with our services, the consultation fee is non-refundable.

4. Quotes, estimates & pricing

Any prices, package ranges, or figures shown on our website or discussed during a consultation are estimates provided for planning purposes only. They are not a binding offer. Final pricing is determined and set out in a written service agreement, and may vary based on site conditions, project scope, materials, and other factors identified during assessment.

5. Service agreements & scope of work

The actual work we perform is governed by a separate written service agreement that describes the scope of work, materials, timeline, and price. In the event of any conflict between these Terms and a signed service agreement, the service agreement controls for that project. These Terms continue to govern your use of our website and the general relationship between us.

6. Scheduling, deposits & cancellations

Project scheduling, deposit requirements, and cancellation or refund terms are described in your service agreement and/or below:

7. Warranty & plant establishment guarantee

We stand behind our installations with a plant establishment guarantee, on the terms described below:

8. Client responsibilities

To allow us to perform the work safely and properly, you agree to:

• Provide accurate information about your property and your needs;
• Provide safe, lawful access to the work area during scheduled times;
• Obtain any required homeowner association (HOA), permit, or other approvals, unless we have agreed in writing to assist;
• Disclose known underground utilities, irrigation lines, or hazards on the property; and
• Follow care and watering instructions after installation, including those required to maintain any guarantee.

9. Website use

You agree to use our website only for lawful purposes. You may not attempt to disrupt the website, gain unauthorized access to our systems, or use the website in any way that could damage or impair it or interfere with others’ use of it.

10. Intellectual property

All content on this website, including text, graphics, logos, photographs, and designs, is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, or reuse our content without our prior written permission. Custom garden designs we prepare remain our intellectual property except as otherwise agreed in writing.

11. Disclaimers

Our website and its content are provided on an “as is” and “as available” basis without warranties of any kind, to the fullest extent permitted by law. Plants are living things; while we use Colorado-appropriate native and low-water species and professional methods, we cannot guarantee specific growth, appearance, or outcomes beyond what is expressly stated in your guarantee or service agreement.

12. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to the services, the website, or these Terms will not exceed the amount you actually paid to us for the services giving rise to the claim. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of use, or property damage not directly caused by our negligence, even if we have been advised of the possibility of such damages. Some of these limitations may not apply where prohibited by law.

13. Indemnification

You agree to indemnify and hold harmless Colorado Eco Garden and its owner, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the website, your failure to obtain required approvals, or inaccurate information you provide to us.

14. Governing law & disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or our services will be brought exclusively in the state or federal courts located in El Paso County, Colorado, and you consent to the jurisdiction of those courts.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
